SwellDesk is operated by Swell & Stack Co. LLC, doing business as Swell & Stack Co., a Wyoming limited liability company ("we," "us," "SwellDesk"), 30 N Gould St, Ste R, Sheridan, WY 82801, USA. By using SwellDesk or paying for a subscription, you (the clinic or business, "you") agree to these terms.
U.S. company serving the Philippines. Although many SwellDesk customers are Philippine clinics, SwellDesk is provided by a United States company. We operate no Philippine entity or local office; the service is delivered from the United States and these terms are governed by U.S. (Wyoming) law, as set out below.
SwellDesk is a hosted, AI-powered chat assistant ("AI receptionist") that answers questions from your website visitors 24/7 and forwards their inquiries to you. We build, host, and maintain it for you. We may improve, change, or update features over time.
SwellDesk is a monthly subscription. Current pricing is ₱14,999/month(regular) or ₱9,999/month (founding rate, for the first 10 clinics, locked in for as long as you stay subscribed). There is no setup fee.
SwellDesk is month-to-month with no long-term contract — cancel anytime. To cancel, email [email protected] (or manage your card subscription through the billing link we provide). Cancellation stops future renewals; your service stays active through the end of the paid month.
Because SwellDesk is a low-cost, cancel-anytime service that is built and hosted for you, monthly fees already paid are generally non-refundable, and there are no partial-month refunds. If something goes wrong on our end — for example a billing error or a material failure of the service — email us within 14 days and we'll make it right, which may include a credit or refund. Nothing here limits any refund right you have under applicable law.
You're responsible for the content and instructions you give us for your assistant and for the inquiries you receive. Don't use SwellDesk for anything unlawful, deceptive, or that infringes others' rights. You must have the right to collect and handle any patient information the assistant gathers on your behalf, and you are the controller of that information once it reaches you.
SwellDesk uses AI language models. Its responses are generated automatically and may occasionally be inaccurate or incomplete. It is not medical, legal, or professional advice, and it does not replace your staff's judgment. SwellDesk is configured to avoid quoting prices or giving medical advice and to route patients to your consultation, but you are responsible for reviewing how it represents your business.
We work to keep SwellDesk running reliably but don't guarantee uninterrupted service. Maintenance, third-party outages (for example the AI provider or hosting), or events outside our control may cause downtime.
We own the SwellDesk software, platform, and templates. You own your business content and the patient inquiries delivered to you. You may use the assistant we build for your business for as long as you're subscribed.
To the fullest extent permitted by law, SwellDesk is provided "as is," and our total liability for any claim relating to the service is limited to the amount you paid us in the three months before the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or lost business.
These terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law principles, and any dispute will be handled in the state or federal courts located in Wyoming, unless applicable consumer-protection law requires otherwise.
We may update these terms; the current version always lives here with its effective date. Continuing to use SwellDesk after a change means you accept the updated terms.
